Our Fees

DESIGNATION OF REPRESENTATIVE – I hereby authorize Empire Tax Reductions DBA of ETR, Inc. (ETR) to process my application for a property tax reduction in 2018 for the applicable tentative assessment roll. To represent me before the Board of Assessment Review (Assessment Review Commission in Nassau County) and/or Small Claims Assessment Review pursuant to my rights guaranteed by NYS Property Tax Law, and to negotiate any settlement of my claim.

FEES: I have read and understand that I will pay ETR a percentage of the tax reduction/savings that they obtain for my property for the year filed. The percentage rate is determined by the county in which my property is located and as follows:

I understand that ETR does not charge a fee if there is no reduction. If ETR is successful, I agree to pay the *DISCOUNTED FEE stated above for my county. The discounted fee will apply only if I pay (or obtain a written payment agreement with ETR to pay) within 60 days of the postmark date of the communication from ETR enclosing my invoice and a copy of official documentation of the reduction; I understand that if I do not pay within that time then the full **UNDISCOUNTED FEE will be applicable. I also agree that if the property is sold before the grievance is completed I will remain responsible for the fees incurred unless the new owner assumes responsibility for such fees by signing ETR’s application/retainer. In the event that I default on this payment agreement, I agree to pay reasonable collection/attorney’s fees incurred by ETR and 1% interest per month on the amount due from the date of the invoice. I also agree that the courts located in Nassau County shall have exclusive jurisdiction of any dispute or action relating to this agreement, and that service upon me by mail at the address listed in this agreement shall be sufficient notice of any such dispute or action. I hereby authorize ETR to negotiate any municipality refund checks obtained and deduct its fees therefrom. Should my case require an appeal, a Court imposed filing fee ($30) may apply and I agree to pay such fee.

ELIGIBILITY: I understand that only A) a person named in the County records as a homeowner; or B) that person’s authorized agent; or C) a person who has contracted to buy a home; or D) the estate of a deceased homeowner, is eligible under law to receive a property tax refund. If you are not in any of these categories, you will not be able to receive a property tax refund and should not sign this agreement. I hereby represent that by signing below I am one of the persons listed within these categories.

NOTIFICATIONS: I am not required by law to use a tax reduction service to apply for a reduction in assessment and that I can cancel within 10 days of signing this agreement, without penalty, by written notice. ETR will make reasonable effort to communicate the terms of any offer of settlement made in the course of these proceedings. ETR is an independent company & not affiliated with any municipality. Complaints regarding any service rendered or not rendered under this contract may be addressed to the Nassau County Office of Consumer Affairs.

(For Orange, Rockland & Westchester Counties only: I understand that I may be requested to produce documents for the Board of Assessment Review and I agree to provide copies of requested documents (to the extent I have them) to ETR.) (For Orange & Rockland Counties only: ETR reserves the right to assign this contract for processing, with the same terms and conditions, to their affiliate ACG of NY, Inc, without further notice.)

I have agreed to the terms and conditions and agree to have ETR, Inc file my Property Tax Grievance in 2018. I am qualified to authorize this agreement per the terms above, and agree that my signature is binding.
